What does the minimum wage include?
The guaranteed gross minimum wage (SMBGP) represents the minimum base salary level set by Government Decision, below which no employer can go. It includes the base salary, without bonuses, incentives, premiums, overtime, or other additions. From the gross salary, the following are mandatory deductions: social insurance contribution (CAS — 25%), health contribution (CASS — 10%), and income tax (10% of taxable income).
Who receives the minimum wage?
The minimum wage applies to all employees with an individual employment contract (CIM), regardless of sector, organizational form, or capital type. It is estimated that approximately 1.5-2 million Romanians are paid at the minimum wage level. The most affected categories include: workers in trade, HoReCa, agriculture, construction (for unskilled personnel), manufacturing, and cleaning services.
When is the minimum wage updated?
The minimum wage is set by Government Decision (HG), usually in the last quarter of the year, effective from January 1 of the following year. The government consults social partners (unions and employers) and considers the inflation rate, labor productivity, cost of living, and average wage levels. In some years, there have been two increases within the same year (e.g., 2018 and 2019). The European directive on adequate minimum wages (2022/2041) requires member states to ensure an adequate level, relative to 50% of the gross average wage or 60% of the gross median wage.
